Santa Ana's Behr reaches settlement with EPA

Company will pay a $15,600 fine for sale of unregistered pesticide.

Santa Ana-based Behr Process Corp. has agreed to a settlement of $15,600 with the U.S. Environmental Protection Agency in response to the sale of an unregistered pesticide in violation of federal pesticide law.

The product, Behr No. 62 Interior & Exterior Multi-Surface Cleaner and Mildew Stain Remover, was targeted because of its claim to remove algae and fungus, which classifies the product as a pesticide.  However, the product was not registered as such.

“Products whose labels make claims to remove living organisms, including algae and fungus, are considered pesticides and must be registered,” says Katherine Taylor, associate director of the agency's Communities and Ecosystems division.

Taylor says that companies with unregistered pesticide products are in violation of federal law and may be subject to fines.
