Companies with such products must register them with the EPA before sale and distribution of the product. Not to do so violates the Federal Insecticide, Fungicide and Rodenticide Act, which not only requires registration of pesticide products, but also that of pesticide-production facilities and proper pesticide labeling.
The EPA was made aware of the violation through a California Department of Pesticide Regulation retail inspection of Home Depot in Oxnard. It was also reported by the Arizona Department of Agriculture during a retail inspection of Home Depot in Surprise, Ariz.
